This book presents new findings that deal with different facets of the well-being of children and their relevance to the proper treatment of children. The well-being of children is considered against the background of a wide variety of legal, political, medical, educational and familial perspectives. The book addresses diverse issues from a range of disciplinary perspectives using a variety of methods. It has three major sections with the essays in each section loosely organized about a common general theme. Der Artikel untersucht die Frage nach einer möglichen Freigabe von Doping im Sport aus einer nachhaltigkeitstheoretischen Perspektive. Im ersten Teil des Aufsatzes wird der Nachhaltigkeitsbegriff zunächst als umweltethischer Begriff entwickelt, weil er aus dem umweltethischen Diskurs stammt und hier bereits systematisch untersucht wurde. Der zweite Teil stellt dar, dass man den Begriff der Nachhaltigkeit auch auf Personen – im Sinn eines verantwortungsvollen Selbstverhältnisses – anwenden kann. Vor diesem Hintergrund wird ein indirektes, nachhaltigkeitstheoretisches Argument gegen eine Freigabe von Doping im Sport (...) entwickelt. Kritikwürdig ist nicht Doping an sich. Problematisch sind vielmehr die einer Freigabe von Doping zugrunde liegenden Werte; vor allem der eines verabsolutierten Leistungsdenkens, dem ein nachhaltiger Umgang mit sich selbst entgegensteht. Der dritte Teil des Aufsatzes untersucht eine wichtige normative Implikation dieser These: Wenn wir Doping im Leistungssport kritisieren wollen, müssen wir sehr viele Handlungsweisen kritisieren, die heute weitestgehend akzeptiert werden. Die in diesem Band vorliegendenAufsätze von Volker Schürmann, Claudia Pawlenka und BenjaminHuppert & Joachim Wündisch gehen partiell auf einige dieser Werteein und diskutieren sie im Rahmen aktueller philosophischer Debatten.

Für viele liberale Denker fällt die religiöse Erziehung der eigenen Kinder unter die Erziehungsautorität der Eltern. Das heißt, dass die Eltern für ihre Kinder entscheiden sollen, ob Letztere religiös erzogen werden und welche Religion hierbei unter Umständen zugrunde liegen soll. In diesem Aufsatz wird ein Argument von Matthew Clayton kritisch diskutiert, das dieses traditionell liberale Verständnis der Erziehungsautorität infrage stellt. Clayton geht von Rawls‘ Rechtfertigungsmodell legitimer Autorität aus, nach dem staatliche Autorität durch öffentlich zugängliche Gründe zu rechtfertigen ist. Clayton wendet (...) dieses sogenannte Prinzip der Legitimität auf den Bereich der Familie an, woraus für ihn folgt, dass die religiöse Erziehung von Kindern auf einer illegitimen Ausübung von Autorität beruht, wenn Eltern ihre Kinder so beeinflussen wollen, dass diese die von ihnen bevorzugten religiösen Überzeugungen annehmen. Für Clayton muss die legitime Ausübung der Erziehungsautorität der Eltern auf die zukünftige Zustimmung, seinen retrospektiven „consent“, Bezug nehmen. Am Ende des Aufsatzes wird – unter Berücksichtigung von Clayton-Kritikern – untersucht, ob es Formen religiöser Erziehung gibt, die vereinbar sind mit dem Prinzip der Legitimität. (shrink)

The main purpose of our paper consists in establishing the idea that the negative consequences that result from child poverty can be mitigated if the government and social workers promote the resilience of poor children. We use Amartya Sen’s capability approach as an evaluative framework to argue for this thesis. By distinguishing different sources of vulnerability we assume that children are inherently vulnerable, because they are dependent and in need of care. Poor children are, however, even more vulnerable in specific (...) ways. Following Catriona Mackenzie, we call these vulnerability “pathogenic”; they are caused by social arrangements like institutional settings. We claim that at least some of those vulnerabilities can and should be diminished by promoting children’s resilience. We proceed in three steps. In the first part of the paper, we develop our concept of vulnerability and explain how child poverty renders children vulnerable to specific harms. Here we also introduce the capability approach by asking which capabilities children need for coping with this situation. In part two we argue that the concept of resilience helps us to understand why capabilities are relevant for coping with the adverse effects of child poverty. We claim that promoting the capabilities of children is a matter of justice, and that implementing resilience is, too. It is also highly important to see that promoting resilience is mainly a social matter, not a task the individual child has to fulfil on its own. Hence, we argue that children are entitled to gain those capabilities that promote their resilience against the adverse effects of poverty. In part three we discuss several difficulties of our account, such as the danger that children will be burdened with coping with the effects of poverty instead of society fighting poverty. (shrink)

The article discusses issues of interaction between the scientific systems of Eastern and Western Europe in the context of current global and local conflicts. Also, ethical issues are considered in connection with solving such problems in science, as well as examining similarities and differences of the scientific systems and their possible modelling. Some practical recommendations are included, based on the suggested academic speculations.

The concept of human dignity has remained surprisingly absent from philosophical discussions about the ethics of childhood so far. Likewise, children as a group are mostly neglected in the ongoing discourse on human dignity. In this paper, we attempt to close this double gap by showing that there is, first, a meaningful way to speak of children’s dignity, and that, second, considering children as a group can be illuminating for dignity theorists in general. After an analysis of the reasons why (...) the debates on human dignity and the ethics of childhood have been conducted almost entirely separately, we develop a concept of respecting children as respecting their dignity. Drawing upon personhood accounts of human dignity, we suggest that respecting a child’s dignity means respecting her activity, which means essentially developing and maintaining a perspective of one’s own. Construed in that way, respecting children’s dignity is in some important respects different from concerns about their well-being and their autonomy. In the last section, we will take a step back from the debate about the ethics of childhood and point to some possible conclusions for the debate about human dignity in general. (shrink)

Over the last few years there has been a resurgent interest in various scientific disciplines in Popper’s arguments. To gain a greater appreciation of Popper’s scientific arguments, they need to be viewed in relation to his broader philosophy and where this stands within the history of ideas. This book aims to take seriously those aspects of Popper’s writings that have received less attention and wherein he advanced metaphysical, speculative, mystical-poetic, aesthetic and Platonic arguments. Such arguments are crucial for an appreciation (...) of his scientific and political writings. I argue that Popper, much like Wittgenstein previously has been misconstrued as an Anglo-analytic philosopher. This book provides an interpretation of Popper’s mature philosophy within his Central-European intellectual context. The aim of which is to open up a fruitful line of investigation into Popper’s thought that I hope would continue over the coming years. Alexander Naraniecki has spent time at the Popper Archives at the University of Klagenfurt in Austria whilst researching for this book. He has also been a visiting scholar at Duke University and has completed a postdoctoral research fellowship at Deakin University in Melbourne. Dr Naraniecki also publishes on issues relating to multiculturalism, globalization, cosmopolitanism as well as inter-cultural relations and dialogue. He has published on Popper in various leading journals such as Philosophy, Boston Studies in the Philosophy of Science, and The European Legacy. He is currently building his research on Popper in a broader direction by exploring issues related to creativity and problem solving for critical thinking. (shrink)

In the Preussen contra Reich case of 1932, Carl Schmitt’s theories on equal chance and law in extreme conditions are interpreted and applied in a court of law, firstly by Schmitt himself, then, going contrary to Schmitt’s interpretation, by Dr. Arnold Brecht and Dr. Hans Peters. This paper will first present the basis of the two theories from Schmitt’s “Legality and Legitimacy,” namely, equal chance and the need for extraordinary measures. Then this paper will focus on the diverging legal interpretations (...) of these two theories, as presented in court by different legal theorists. These divergent interpretations of “equal chance” and “law in extreme conditions,” as presented in the aforementioned case, have yet to reach an international readership, as the case itself has never been fully translated into English. Finally, this paper will question the practical application of the two theories in the reality of the empirical world, which in turn question the relationship between any parliamentary legislative system and law. But of the dozen or more major meetings of this sort held across the country, the one held at the National Institutes of Heakh (NIH) in Bethesda, MD, June 2-4, 1991, was distinctive in several respects.1As (...) its name implies, "Human Genome Research in an Interdependent World" was a global look at the issues raised by gene mapping and sequencing. Unlike previous conferences, however, this meeting looked beyond a comparative analysis of clinical and domestic legal issues, and concentrated on topics that may require responses on a truly international level if they are to be successfully resolved.The meeting's organizers gathered an impressive group of more than seventy participants from fifteen countries, including the first significant contingent of Soviet and Japanese scientists, physicians, and philosophers at an ELSI meeting. In addition to talks by the heads of the genome projects in the Soviet Union, Japan, and the United States, the meeting was keynoted by Dr. James Wyngaarden, director general of the Human Genome Organization (HUGO), and I had the honor of serving as its general chairman.The goal of the meeting was to consider an array of issues that scientists, philosophers, and lawyers from around the world suggested might have international significance, with an eye to deciding three things: (1) Does the issue deserve further attention? (2) Is the issue best addressed in an international or domestic context? and (3) Do structures exist to which the issue can be referred for resolution? In the final sessions, the entire group debated proposed resolutions on the various topics and narrowed the list needing further, intensive exploration.To provide an international framework for this process, the conference [End Page 247] established a Global Steering Committee on Ethical and Social Issues in Genome Research, which will coordinate the efforts of several task forces charged with refining the tentative resolutions adopted by the conference participants on June 4. In 1865, in his great work, An Introduction to the Study of Experimental Medicine, Dr. Claude Bernard, the French physician who first established the use of the scientific method in medicine, echoed the earlier injunctions of physician-moralist Moses Maimonides in counseling his fellow physicians not to treat their patients solely as a means of advancing knowledge. Yet such cautions had no apparent effect on the physicians who, (...) at the end of the 19th century, studied the transmission of venereal diseases by intentionally infecting poor and institutionalized people without their knowledge, much less their consent. While the presence or absence of consciousness plays the central role in the moral/ethical decisions when dealing with patients with disorders of consciousness (DOC), recently it is criticized as not adequate due to number of reasons, among which are the lack of the uniform definition of consciousness and consequently uncertainty of diagnostic criteria for it, as well as irrelevance of some forms of consciousness for determining a patient’s interests and wishes. In her article, Dr. Specker Sullivan reexamined the meaning of (...) consciousness in the DOC taxonomy and proposed to go away from the routinely used clinical definition of consciousness as “wakeful awareness”, and adopt the meaning that is common in the Eastern tradition which is a form of “pure experience” (Specker Sullivan 2018). She further argued that understanding consciousness as a “pure experience” is ethically relevant for DOC patients. This suggestion is original, novel and important since it preserves the importance of the notion of consciousness for the clinical practice while simultaneously offering an additional ethical tool for the moral decisions in medicine. At the same time, without placing such Eastern notion in the Western tradition it is difficult to see how pure experience could be usefully operationalized to make sense in the clinical practice with DOC patients. It is so because pure experience is a subjective phenomenon which is completely inaccessible in noncommunicative DOC patients and also it does not express behaviorally (Monti et al 2010), therefore some objective-like operationalization is needed. This is why the fusion of Eastern and Western traditions is required to gain the full potential of Dr. Specker Sullivan’s suggestion. We propose that such fusion could be achieved on the basis of the Operational Architectonics (OA) theory of brain-mind functioning (Fingelkurts et al. 2010; 2013a) which suits ideally the purpose due its compatibility with both Western and Eastern traditions of consciousness. The target paper of Dr. Feinberg is a testimony to an admirable scholarship and deep thoughtfulness. This paper develops a general theoretical framework of nested hierarchy in the brain that allows production of mind with consciousness. The difference between non-nested and nested hierarchies is the following. In a non-nested hierarchy the entities at higher levels of the hierarchy are physically independent from the entities at lower levels and there is strong constraint of higher upon lower levels. In a nested hierarchy, (...) higher levels are physically composed of lower levels, and there is no central control of the system resulting in weak constraint of higher upon lower levels. (shrink)

Dr. Vukov analyzing patients with disorders of consciousness, proposed that medical well-regarded policy recommendations cannot be justified by looking solely to patients’ actual levels of consciousness (minimally conscious state – MCS versus vegetative state – VS), but that they can be justified by looking to patients’ potential for consciousness. One objective way to estimate this potential (actual physical possibility) is to consider a neurophysiologically informed strategy. Ideally such strategy would utilize objective brain activity markers of consciousness/unconsciousness. The Operational Architectonics (OA) (...) theory of brain-mind functioning is an example of such a strategy. Besides being mathematically simple, neurophysiologically accurate, and compatible with the cognitive/phenomenal perspectives on consciousness, application of OA strategy to quantitative EEG analysis of patients in VS and MCS revealed that the absence of consciousness in VS is paralleled by impairment of overall EEG operational architecture. Specifically, neuronal assemblies become smaller, their life span shortened, and they became highly unstable and functionally disconnected (desynchronized). At the same time, fluctuating (minimal) awareness in patients in MCS was paralleled by partial restoration of EEG operational architecture (increased size, life span, and stability of neuronal assemblies, together with an increased number and strength of functional connections among them), approaching the level found in healthy fully conscious participants. Moreover OA strategy to EEG analysis allowed predicting the emergence of consciousness in VS patients after six years following the brain trauma. Therefore, the OA methodology could reliably predict which patients may regain consciousness, and thus determine which patients may have the potential for consciousness. (shrink)

Hadrianoupolis lies on the principal western route from the Central Anatolian Plain through the mountains to Bartın and the Black Sea, 3 km west of the modern town of Eskipazar, near Karabük, in Roman Paphlagonia. It was a small but important site which controlled this major route and dominated a rich agricultural, especially vinicultural, enclave.In 2003 the local Archaeological Museum of Ereğli began a small-scale salvage excavation of the newly discovered main church of Hadrianoupolis, known as “Early Byzantine Church B”, (...) situated in the centre of the ancient city. Only the floor and foundation levels are preserved. The church was erected probably in the early 6th century AD and may have still been in use as late as the 7th century. The most important discoveries at Church B were the floor mosaics which show personifications of four Biblical rivers: Euphrates, Tigris, Phison and Geon. Animals, floral and geometric designs, and an extensive inscription are also represented.In 2006 archaeological excavations were begun in Hadrianoupolis by a team from the Dokuz Eylül University, İzmir, under the direction of Dr Ergün Laflı. As a result of our 2005 surveys, it has now been confirmed that Hadrianoupolis lay indeed on the site of modern Eskipazar, with finds dating from the 1st century B.C. to the 8th century A.D. It also was determined that the core of the ancient city extended as far as the modern village of Budaklar and the surrounding districts of Hacı Ahmetler, Çaylı and Eleler, along the Eskipazar-Mengen highway for 8 km east-west and 3 km north-south. The chora of Hadrianoupolis is much more extensive in size.The field surveys in 2005 identified the remains of at least 24 buildings at the site. Among them are two bath buildings of the Late Roman period, two Early Byzantine churches, a fortified structure of the Byzantine period, a theatre , a vaulted building, a domed building and some domestic buildings with mosaic floors. In 2006 trenches were opened to investigate two of the best preserved of these buildings: Bath A and Early Byzantine Church A. In 2007 “Bath A”, “Bath B”, a Late Roman villa, an absidal Early Byzantine building, as well as two Roman monumental rock-cut graves, were excavated.The 2006–2007 campaigns have established that Hadrianoupolis was a fortified regional centre during the late Roman and early Byzantine period , when it can easily be defined as a “polis” with civic buildings and a fairly large urban population, as well as an extensive agrarian rural population. Catalytic antibodies, or abzymes, obtained by the structural mimicking of enzyme active sites have been shown to catalyze numerous chemical reactions. Natural enzyme analogs for some of these reactions have not yet been found or possibly do not exist at all. Nowadays, the dramatic breakthrough in antibody engineering and expression technologies has promoted a considerable expansion of immunoglobulin's medical applications and is offering abzymes a unique (...) chance to become a promising source of high‐precision “catalytic vaccines.” At the same time, the discovery of natural abzymes on the background of autoimmune disease revealed their beneficial and pathogenic roles in the disease progression. _Dreams of a Spirit-Seer_, Immanuel Kant's book on Emanuel Swedenborg, has mystified readers since its publication in 1766 during Swedenborg's lifetime. The unusual style and content of _Dreams_ have given rise to two opposing interpretations. Most Kant scholars regard the work as a skeptical attack on Swedenborg's mysticism. Other critics, however, believe that Kant regarded Swedenborg as a serious philosopher and visionary, and that _Dreams_ both reveals Kant's profound debt to Swedenborg and coneals that debt behind the mask of irony. (...) In addition, Dr. Gregory R. Johnson provides selections from other Kantian writings that mention Swedenborg and also contemporary reviews of _Dreams_, showing that Kant himself was ambivalent about Swedenborg's claims and that readers of his day questioned his position. Rationale: Deep brain stimulation (DBS) of the hippocampus is proposed for enhancement of memory impaired by injury or disease. Many pre-clinical DBS paradigms can be addressed in epilepsy patients undergoing intracranial monitoring for seizure localization, since they already have electrodes implanted in brain areas of interest. Even though epilepsy is usually not a memory disorder targeted by DBS, the studies can nevertheless model other memory-impacting disorders, such as Traumatic Brain Injury (TBI). Methods: Human patients undergoing Phase II invasive monitoring for (...) intractable epilepsy were implanted with depth electrodes capable of recording neurophysiological signals. Subjects performed a delayed-match-to-sample (DMS) memory task while hippocampal ensembles from CA1 and CA3 cell layers were recorded to estimate a multi-input, multi-output (MIMO) model of CA3-to-CA1 neural encoding and a memory decoding model (MDM) to decode memory information from CA3 and CA1 neuronal signals. After model estimation, subjects again performed the DMS task while either MIMO-based or MDM-based patterned stimulation was delivered to CA1 electrode sites during the encoding phase of the DMS trials. Each subject was sorted (post hoc) by prior experience of repeated and/or mild-to-moderate brain injury (RMBI), TBI, or no history (control) and scored for percentage successful delayed recognition (DR) recall on stimulated vs. non-stimulated DMS trials. The subject’s medical history was unknown to the experimenters until after individual subject memory retention results were scored. Results: When examined compared to control subjects, both TBI and RMBI subjects showed increased memory retention in response to both MIMO and MDM-based hippocampal stimulation. Furthermore, effects of stimulation were also greater in subjects who were evaluated as having pre-existing mild-to-moderate memory impairment. Conclusion: These results show that hippocampal stimulation for memory facilitation was more beneficial for subjects who had previously suffered a brain injury (other than epilepsy), compared to control (epilepsy) subjects who had not suffered a brain injury. This study demonstrates that the epilepsy/intracranial recording model can be extended to test the ability of DBS to restore memory function in subjects who previously suffered a brain injury other than epilepsy, and support further investigation into the beneficial effect of DBS in TBI patients. During the summer of 1774, five “electric eels” survived the voyage from Surinam to Charles Towne (Charleston), South Carolina. Naturalists knew that these river fish actually only resembled eels. They also knew that that Carl Linnaeus had recently classified them as Gymnotus electricus (Linnaeus 1766; today they are Electrophorus electricus). But to most people, and even among natural philosophers, they were (and still are) loosely referred to as “eels.” For those willing to pay, a group that included physicians, gentlemen-scientists, and (...) other inquisitive minds, there was an opportunity to observe them.
